1. Acceptance of Terms

By inviting DinkDonk Bot to your Discord server or using any of its features, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Bot.

2. Description of Service

DinkDonk Bot ("the Bot") is a Discord bot that provides Twitch stream notifications, clip updates, and emote management functionality for Discord servers.

3. Use of the Bot

3.1 Eligibility

You must be at least 13 years old to use the Bot. By using the Bot, you represent that you are at least 13 years old.

3.2 Discord and Twitch Terms

Using the Bot requires compliance with both Discord's Terms of Service and Twitch's Terms of Service. The Bot interacts with both platforms, and your usage must comply with their respective policies.

3.3 Permitted Use

You may use the Bot for its intended purposes within your Discord server. You may not:

Use the Bot to violate any laws or regulations
Attempt to disrupt or interfere with the Bot's operation
Exploit bugs or vulnerabilities in the Bot
Use the Bot to harass, threaten, or violate the rights of others

3.4 Custom Messaging Content

The Bot allows you to configure custom messages for stream notifications. You agree that these custom messages will not contain:

Hate speech, harassment, or discriminatory content
Sexually explicit or graphic violent content
Content that violates the rights of others
Malicious links or code
Any other content that violates Discord's Community Guidelines

We reserve the right to remove or disable custom messages that violate these terms.

3.5 Emote Management

The Bot allows you to add emotes from other Discord servers or 7TV. By using this feature, you represent that:

You have the right to use and distribute these emotes
The emotes do not infringe on any intellectual property rights
The emotes comply with Discord's Terms of Service and Community Guidelines

You are solely responsible for any copyright or trademark violations related to emotes you add using the Bot.

The Bot interacts with third-party APIs such as Twitch, Discord, and 7TV. Your use of the Bot is subject to the rate limits and usage restrictions of these platforms. We may implement additional rate limiting to ensure fair usage across all users. Attempting to circumvent these limits may result in temporary or permanent suspension of your access to the Bot.

4. Data Collection and Privacy

The Bot collects and stores specific data necessary for its operation, including Discord server IDs, channel IDs, and Twitch streamer information. Please refer to our Privacy Policy for more details on data collection, usage, and retention.

5. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Bot at any time without prior notice. We may also update these Terms of Service from time to time. Continued use of the Bot after any changes constitutes acceptance of the revised Terms.

5.1 Service Availability

While we strive to maintain high uptime for the Bot, we do not guarantee uninterrupted service. The Bot may experience downtime due to:

Maintenance or updates
Discord or Twitch API limitations or outages
Technical issues or bugs
Other factors beyond our control

We are not liable for any damages or losses resulting from service interruptions.

6. Limitations of Liability

The Bot is provided "as is" without any warranties, expressed or implied. We are not responsible for any damages or losses related to your use of the Bot. We do not guarantee that:

The Bot will meet your specific requirements
The Bot will be uninterrupted, timely, secure, or error-free
Any errors in the Bot will be corrected

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Bot developer resides, without regard to its conflict of law provisions.
